Terms and Conditions

Important Notes:

This application form is applicable to local and international students only. Incomplete applications will not be processed. Please complete all information requested on the application form. All supporting documentation should be attached to your application.

Confidentiality Clause: Gavin’s Tuition is committed to maintaining the confidentiality of personal information and undertakes not to divulge any of the applicants’ personal information to any third party without the prior consent of the applicant.

This Enrollment Agreement ‘Agreement’ binds both Gavin’s Tuition and the Student once the Student accepts these Terms and Conditions.

If the student is under eighteen (18) years of age, the Student will be represented by the Parent/Legal Guardian. If the Parent/Legal Guardian is not available in Singapore for the purposes of signing the Agreement, the Agreement, the Parent/Legal Guardian will have to acknowledge and agree to the Agreement by means of a written letter.

NOW IT IS HEREBY AGREED as follows:

1. TUITION FEES AND DEPOSIT

1.1 The Student’s monthly tuition fees will be computed on a per lesson basis for each subject enrolled. The Student’s monthly tuition fees will be payable on or before the 5th day of each month.

1.2 In the event of late payment, the Student will incur a non-refundable late payment charge of S$50. The late payment charge is payable with the tuition fees of the month on which the payment is late.

1.3 There is a refundable deposit of S$150.00. The deposit is separate from the tuition fee and cannot be used to offset the payable monthly tuition fees. The deposit will be payable together with the Student’s tuition fee for the first month. The deposit shall be refunded upon valid termination as set out in Clause 5.

1.4 For new registration, a non-refundable registration charge of S$20 will be required. If a student did not attend any lessons within three calendar months, a new registration will be required upon their return and the registration fee charge will be applied.

1.5 For material, each annual academic year is based on four academic terms. The annual material fee is $80 and non-refundable and will be collected at the start of the academic year. In the event a student enrolled after the start of the academic term, the annual material fee will be prorated based on the number of academic terms left in that year.

1.6 Any discount to the tuition fees shall be made at the sole and absolute discretion of the Institution.

2. RESCHEDULING

2.1 Kindly take note that Gavin’s Tuition has a NO MAKE-UP POLICY for classes missed regardless of reasons. However, please do note that any make-up classes requested can still be filed and all make-up classes conducted is out of the Tutor’s goodwill and shall not be deemed as an obligation.

2.2 There shall be NO PRO-RATE OF FEES for classes missed regardless of any reasons.

2.3 There shall be NO REFUND OR CARRY FORWARD of tuition fees if the Students failed to attend the scheduled or make up class within the month of absence.

2.4 There shall be NO TOPPING UP OF CLASS TIME for Students who arrived late for class.

2.5 The institution reserves the right to amend the Student’s class size, class tutor and composition and the date and timing of class.

3. GENERAL

3.1 The Student shall adhere to the Code of Conduct as set out in each paragraph of the Schedule to the best of his/her abilities at all times. If the student is in breach of the terms under the Schedule, the Institution is entitled to enforce disciplinary action against the student.

3.2 The Institution shall use its best reasonable efforts to help the Student meet the Student’s academic objectives. However, the Institution does not guarantee any improvement in the Student’s academic performance.

3.3 The Institution shall not be liable for any physical injury or harm suffered by the Student due to the Student’s negligence while present in the premises of the Institution.

3.4 The Institution is entitled to use the Student’s achievements for its newsletter or marketing materials.

4. RESTRICTIONS

4.1 You shall be deemed to have given consent for us to collect the personal data contained within this Agreement. In the course of your enrollment, we generally will not collect your personal data unless:

a) It is provided to us voluntarily by you directly or your representative, and;

b) You or your representative have been notified of the purposes for which the data was collected.

4.2 We may collect and use your personal data for any or all of the following purposes:

a) Performing obligations in the course of or in connection with our provision of goods and/or services requested by you;

b) Verifying your identity;

c) Responding to, handling, and processing queries, requests, applications, complaints, and feedback from you;

d) Managing your relationship with us;

e) Processing payment or credit transactions;

f) Sending you marketing information about our goods or services including notifying you of our marketing events, initiatives and promotions, lucky draws, memberships and rewards schemes and other promotions;

g) Complying with any applicable laws, regulations, codes of practice, guidelines, or rules, or to assist in law enforcement and investigations conducted by any governmental and/or regulatory authority;

h) Any other purposes for which you have provided the information;

i) Transmitting to any unaffiliated third parties including our third-party service providers and agents, and relevant governmental and/or regulatory authorities, whether in Singapore or abroad, for the aforementioned purposes;

j) The creation and publishing of marketing or other promotional materials; and

k) Any other incidental business purposes related to or in connection with the above.

4.3 We may disclose your personal data:

a) Where such disclosure is required for performing obligations in the course of or in connection with our provision of goods or services requested by you; or

b) To third party service providers, agents and other organizations we have engaged to perform any of the functions listed in Clause 5 below for us.

4.4 The purposes listed in the above clauses may continue to apply even in situations where your relationship with us (for example, pursuant to a contract) has been terminated or altered in any way, for a reasonable period thereafter (including, where applicable, a period to enable us to enforce our rights under any contract with you).

5. TERMINATION

5.1 This Agreement may be terminated at any time by mutual agreement.

5.2 The Student may validly terminate this Agreement giving one (1) month’s notice and one (1) month’s tuition fees in lieu of written notice.

5.3 The Institution has the right to give immediate notice before terminating if the Student is guilty of misdemeanor, misconduct, negligence or breach of any of the terms under this Agreement. The Institution reserves the right not to give any reasons for termination.

6. MISCELLANEOUS

6.1 If any clause of this Agreement is not valid for any reason under the law of Singapore, this will not affect any other clause of this Agreement.

6.2 This agreement shall be governed by and construed in accordance with the law of Singapore and the parties hereby irrevocably submit to the non-exclusive jurisdiction of the Singapore courts.

6.3 All disputes, controversies or differences arising out of or in connection with this contract, including any question regarding its existence, validity or termination, shall be first referred to mediation in Singapore in accordance with the Mediation Rules of the Singapore International Mediation Centre for the time being in force.

7. ENTIRE AGREEMENT AND NON-RELIANCE

7.1 This Agreement constitutes the entire agreement between the parties with respect to the transactions contemplated in this Agreement and supersedes all prior oral and written agreements, memoranda, understandings and undertakings between the parties relating to the subject matter of this Agreement.

7.2 The Student and/or Parent/Legal Guardian acknowledges that it has not been induced to enter into this Agreement by any representation, warranty or undertaking nor expressly incorporated into this Agreement.


SCHEDULE

CODE OF CONDUCT

1. Students have to be punctual for all lessons. Once a student is 25 minutes late following a lesson commencement, he/she will be denied entry to the lesson and the lesson will be considered as attended.

2. No food and drinks (except water bottles) are allowed inside the classroom.

3. No littering is allowed. Students are advised to throw their rubbish into the respective rubbish bins inside their classroom.

4. Usage of projectors is only strictly for tutors for educational purposes. Students are not allowed to use it for recreational purposes.

5. Do not rearrange the tables and chairs without permission.

6. No charging of mobile phones, laptops and any electronic devices inside the classroom. Charging of electronic devices can be done at the pantry/study area.

7. No taking of photos and videos, or any form of recording, during the lesson.

8. No sharing of materials and notes with other students.

9. Students should take ownership of their own belongings and not leave anything behind. Gavin’s Tuition will not be responsible for any losses.

10. No sharing of Gavin’s Tuition accounts credentials with other parties.
